This Privacy Policy (hereinafter the “Policy”) is a contract binding you (meaning the user of Hera IA Inc. products or the client of Hera IA Inc.) to us (meaning Hera IA Inc. or any member or staff of Hera IA Inc.) and representing the meeting of minds relating to the collection, use and disclosure of your personal information.

IT IS ESSENTIAL THAT YOU READ AND FULLY CONSENT TO THE POLICY BEFORE VISITING OUR WEBSITE, BEFORE COMMUNICATING WITH US OR BEFORE CREATING A PROFILE.

By interacting with us, you accept and consent to the collection, use and disclosure of your personal information being governed by this Policy. The interactions covered by the Policy include, among others, visiting and using our web products or products accessed through mobile applications (hereinafter the “Products”) bearing the same or a different name, your communications with us and/or with any other user, as well as payment for the services we offer.

Consent

By providing us with your personal information, you authorize us to use and disclose it in the course of our service delivery, to facilitate relationships with Hera IA Inc., its clients and the users of the Products, and to make it accessible, where necessary, to employees, partners or agents of Hera IA Inc. in the performance of their duties and for purposes directly related to the use, updating or maintenance of the Products, in accordance with this Policy and as authorized or required by law, as well as implicitly where indicated by the circumstances.

Hera IA Inc. will seek your authorization before using your personal information for purposes other than those covered by your initial consent.

You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice. If you provide us with personal information concerning another individual, you undertake to hold the necessary authorization to do so and/or that users have obtained all necessary consents from that individual to allow us to collect, use and disclose that personal information for the purposes set out in this Policy.

What personal information do we collect?

In addition to the personal information we collect when you register (e.g. your last name, first name, address, telephone number and email address) as well as any other information required while you browse our Products (e.g. your geolocation data, payment-related information, etc.), we retain the history of your interactions with the Products, including your reviews, communications and postings on the Products.

We use the audience analysis tool Google Analytics (hereinafter “Google”) in order to obtain certain information about the users of our Products. The information provided by Google is non-identifiable and is intended in particular to inform us about demographic and geographic data of our users (e.g. age, gender, language, territory, etc.), their behaviour on our Products, their affinities (e.g. lifestyle) and the technology they use to access our Products (e.g. browser, operating system, devices used, IP address, etc.).

What technologies do we use to collect your personal information?

When you use our Products, we retain the history of your interactions on our server.

As for the information collected by our audience analysis tool, Google proceeds in particular by writing a number into your browser using a cookie in order to remember your visit. This then allows Google to associate your browser with a demographic category to which you appear to belong based on the other sites you visit. Google also uses your IP address to identify the country, region and city where your computer connects to the Internet to access our Products. For what purposes do we use your personal information?

We use your personal information in particular to meet the following objectives:

Product improvement
Obtain information about the use of the Products in order to increase and improve the user experience.
Services
Provide you with the Products for your business operations.
Statistics
Collect statistics for later publication.
Communications
Send emails to users of the Products and respond to requests made by those users.
Information
Inform users about how the Products work, about what is new and about the services offered by Hera IA Inc., such as updates, our newsletter, and changes to the Terms of Use or to the Policy.
Security and operation
Take any other action necessary to protect security or to ensure the proper operation of the Products.

Unless otherwise indicated, you must assume that any information you provide on the Products may be used for general or commercial solicitation purposes and may also be shared with our partners, affiliated companies, clients or suppliers with whom we maintain business relationships.

How do we protect your personal information?

The entirety of our security measures cannot be disclosed for obvious reasons. We can however inform you that your personal information is stored on our servers and protected by encrypted passwords that are updated regularly.

Despite the security measures put in place to protect your personal information, no measure is infallible.

We undertake to grant access to the Products' data and content only to our employees, collaborators, subcontractors, officers and directors who need such access in order to provide services related to the Products, and they will be required to respect its confidentiality.

BY BROWSING AND USING THE SERVICES OFFERED ON OUR PRODUCTS, YOU ACCEPT AND UNDERSTAND THE RISKS THAT YOUR PERSONAL INFORMATION MAY BE UNLAWFULLY OBTAINED BY THIRD PARTIES AND/OR MALICIOUS SOFTWARE. CONSEQUENTLY, YOU WAIVE ANY RECOURSE AND/OR ANY CLAIM AGAINST HERA IA INC., ITS SUBSIDIARIES, ASSOCIATED COMPANIES, DIRECTORS OR SHAREHOLDERS IN THE EVENT OF THEFT OR MALICIOUS USE OF YOUR PERSONAL DATA BY A THIRD PARTY AND/OR MALICIOUS SOFTWARE.

Who has access to your personal information and to whom is that information disclosed?

Apart from the information you share on our Products or communicate to other users, we are the only ones with access to your personal information. However, some personal information may be shared with our partners or suppliers when your use of the Products requires it.

How long do we keep your personal information?

We limit the retention of your personal information to a maximum period of three (3) years following your use of one of our Products or the closure of your account, whichever is the most recent.

Is it possible to limit the collection of your personal information when you use our Products?

Yes. You may limit the collection of your personal information at any time by installing the Google Analytics Opt-out Browser Add-on. Several other ways to prevent or limit the collection of your personal information are also available on Google's data protection page, under the “Privacy settings” tab.

In addition, you may limit the collection of your personal information by disabling cookies in your browser and by refusing permission requests while browsing our Products, including your geographic location.

How can you make a request to know, update, change or delete your personal information?

Protecting your personal information is a major concern for us. As such, we provide you with many ways to access, correct or delete your personal information promptly, in particular through your user profile page.

It is also up to you to contact our personal information protection officer in order to update or delete your information.

How can you make a request to change your consent for the processing of your personal information?

You may withdraw your consent to the collection, use and disclosure of your personal information at any time, subject to restrictions provided by law, to a stipulation external to this Policy and to ten (10) business days' notice to process your request.

The change request must be made by email to the officer whose contact details appear at the bottom of this page. We will acknowledge receipt of your request by email. We may ask you to confirm your identity before providing you with this information. In principle, access to this information will be provided free of charge, but if you ask us for a copy or a transfer of your information, we may charge a reasonable fee. We will inform you of the amount in advance and give you the opportunity to withdraw your request. We will give users access to their information within ten (10) days of receiving their request, or we will provide them with an email notice informing them that additional time is needed to respond to their request.

In some cases, we may be unable to give access to information concerning you, in whole or in part. If we are unable to do so, or if the law does not permit it, we will provide you with an explanation and indicate the other measures available to you.

Updating this Privacy Policy without notice

This Policy is dynamic and may be changed without notice. You may not assume that it will remain the same, and you agree to check the policy each time you visit one or more Products in order to note any changes. Your continued use of the Products demonstrates your acceptance of the provisions of this Policy and of any change.

In connection with changes made to our Policy, we undertake to use your personal information only under the terms and for the purpose of the Privacy Policy in force at the time you provided us with your information, or as otherwise required or permitted by law, unless you have expressly consented otherwise.

Is it possible that the policy is not followed?

Where the law permits, and even requires it, we may collect, use or disclose, in part or in full, your personal information without your knowledge or without your consent. In such a case, we ensure that the collection, use and disclosure comply with the law and take care to obtain rigorous legal advice to that effect. We reserve the right to contest or to act upon any request relating to the collection, use or disclosure of such personal information.

Discrepancy and interpretation

In the event of a discrepancy between the French version and the English version of this Policy, the French version prevails over any other version. This Policy is governed by the Site's Terms of Use should a dispute or an inconsistency relating to the said Policy arise.
